This privacy policy discloses the privacy practices of Wound Reference, Inc. (“we”, “our” or “us”) and the websites, services and applications we make available to you (“Services”).

What Information We Collect

The types of information that we collect fall under two general categories: personally identifiable information (“PII”) and non-personally identifiable information (“non-PII”). PII consists of any information which can be used to specifically identify you as an individual, whereas non-PII consists of aggregate information or any information that does not reveal your identity. The following sections describe how your PII and non-PII are collected by us, and how we use such information.

How We Collect and Use Information

When you register with us to use the Services, you may be required to provide us with identifying information such as your name, address, email address, and additional information relating to your institution, education, practice and specialty.

We use your email address for login and for sending you certain communications, such as CliniPaths service announcements. These communications are essential to the operation of the app and therefore cannot offer the opportunity to opt-out.

You may OPT-IN to receive notifications from CliniPaths when using other functionalities such as CliniPaths Messages and Tasks (e.g. you can opt-in to receive notifications when another end-user within your CliniPaths Institutional sends you a message using CliniPaths Message, or assigns a Task using CliniPaths Tasks. Other users within other institutional accounts cannot message you or assign tasks to you). You can OPT-OUT from these notifications anytime.

We track usage of the Services on our servers through log files. We may use this information in order to administer the Services, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information that is non-PII (such as your IP addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks).

We use cookies to keep track of some types of information while you are using the Services. Cookies are small data files placed on your computer, and they allow us to do things like count the number of visitors, distinguish repeat visitors from new visitors, save user preferences and track user trends. You may set your browser to disable cookies, but allowing them will improve your user experience and may be necessary for you to use the full functionality of the Services. We use both session cookies, which do not persist after you close your browser, and persistent cookies, which are stored on your computer’s hard drive. We do not link the information we store in cookies to any PII.

We use certain third party web analytics services and those third party analytics services use cookies to help us analyze how users use our website. The information generated by the cookie about your use of our website (including your IP address) will be transmitted to and stored by those third party providers on servers in the United States. This information is used for the purpose of evaluating your use of our website, compiling reports on website activity for our use and providing other services relating to website activity and Internet usage. Our third party providers may also transfer this information to other third parties where required to do so by law, or where such third parties are subcontracted to process the information. These third party providers will not associate your IP address with any other data they hold. As stated above, you may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the Services. By using the Site, you consent to the processing of data about you in the manner and for the purposes set out above.

Service includes a web-based communication tool that allows you to have video conversations with colleagues and patients. The peer-to-peer communications are encrypted and no data relating to the communication is saved.

International Users

If you are a non-US resident, please be advised that we may provide the Site and Services from a jurisdiction that does not have the same data protection laws as your jurisdiction and we may transfer information that we collect about you, including your PII, to subsidiary and affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information about you, including PII, to a country and jurisdiction that does not have the same data protection laws as the European Union, and you consent to the transfer of information about you, including your PII, to the U.S. or to jurisdictions in which our subsidiary and affiliated entities reside; and the use and disclosure of information about you, including your PII, as described in this Privacy Policy.

Disclosure of Your Information to Third Parties

We will only share your information with third parties in the ways defined in this privacy policy.

We may disclose information you provide (including your PII) if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is (1) permitted or required by the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); or (2) is reasonable to protect or defend the rights or property of us or a third party.

We may share your non-PII with third parties, but not in a manner that would reveal your identity. We may share your PII, sometimes in conjunction with your non-PII, with service providers that may be associated with us to perform functions on our behalf. For example, outsourced customer support agents or technology infrastructure providers may need access to your information to perform services for you on our behalf (such as processing payments you make to us). Your information will be treated as private and confidential by such service providers and not used for any other purpose than we authorize.

As we develop our business, we may buy or sell assets and, depending on the transaction, your PII may be one of the transferred assets. In the event that we are acquired by another company, your PII may be part of the assets transferred to the acquiring party. If this occurs, you will be notified if there are any material changes to the way your PII is collected or used.

Age Restrictions

We do not target our Services to children under the age of 13, and in compliance with the Children’s Online Privacy Protection Act, any information we may receive from users we believe to be under the age of 13 will be purged from our database.

Geographic Restrictions

As set forth in the Terms of Use, the Services provided are intended for use by United States residents.

Security

We will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and hence accept no liability for any unintentional disclosure.

The Services may contain links to third party websites. However, we do not control or take any responsibility for the privacy practices of, or information collected by, any third parties, including any affiliated or co-branded websites which link to the Services or advertise on the Services.

Updating Your Information

You may change your password and other information from the “Account Settings” and "Profile Settings" page accessible via a link from the home page on our website. To the extent you choose to include PII or other information in your profile, the Services allow you to update or remove that information by editing or deleting the content.
